Is an item a fixture? The answer depends on two things:

• How securely is it attached to the building? (How difficult is it to remove it?
• Did the parties fit it with the intention that it would become part of the building?

If the goods are now ‘fixtures’ chances are that this supplier is going to have to drop their claim for retention of title.
