Coffee Break Briefing - Cathedrals and Charities

Our third Coffee-Break Briefing of this year will be on Monday 8th March 2021 at 10.30am.

None of us expect to have to deal with an insolvent cathedral!  Cathedrals are charities, and the charitable sector has been hit, at least as badly as any other sector of the economy, by the events of the last 12 months.  We can therefore anticipate that we may be dealing with distressed charities of some form in the coming months.

Malcolm Niekirk will be looking at what makes an insolvent charity different from other types of insolvent organisations.  In this briefing he will be discussing:

  • Different types of charitable organisations:
    • - Companies limited by guarantee
    • - Charitable incorporated organisations
    • - Registered societies
    • - Charitable trusts
    • - Unincorporated charities
    • - And, of course, cathedrals!
  • Beneficial ownership of charitable property (and whether the liquidator can use it):
    • - Permanent endowment
    • - Expendable endowment
    • - Restricted use funds
    • - Unrestricted use funds
    • - Trusts within charities
    • - And, of course, cathedrals!
  • Officers and trustees
    • - Their responsibilities and duties
    • - Their relationship with the charity and its property
    • - Advising them and dealing with them
