HR Forum - May 2010 (early session)

Changing Terms & Conditions of Employment - 26th May 2010

terms & conditions of employment contractsIn our usual forum format, we will be looking at the ability to change employee's terms and conditions of employment. This can be extremely useful and, in these challenging times, often crucial to survival. However, there are many traps for the unwary and one wrong move can give rise to a breach of contract and / or constructive dismissal claim.

Recent case law appears to have 'smoothed' the way for employers seeking to change terms but have also emphasised the importance of properly drafted variation clauses. In the next Forum, we will look at why and how terms of employment can be changed and also review the recent case law.

Our quarterly HR Forums are aimed at those Managing HR issues. They provide an excellent opportunity for HR professionals to meet, share ideas and discuss employment issues, as well as socialise with contemporaries. Kate Fretten and Paul Burton open the Forums with an overview of the legal aspects of the topic and then allow the discussion to develop.
