Sorry. There is no black and white answer. As a general rule, the winner of the ‘Battle of the Forms’ is the person who shoots last. But it takes skill and judgement to analyse the rules of ‘offer and acceptance’ to assess whose piece of paper was the last pre-contractual offer. By all means, try to work it out for yourself, but be prepared to get a lawyer on your side before it gets nasty.
